What are the Eligibility Requirements for ILR As an Innovator Founder?

The eligibility requirements for ILR as an Innovator Founder include the following:

Valid Application: The applicant must submit a valid ILR application in accordance with the requirements for a valid application as set out in Appendix Innovator Founder of the Immigration Rules.

Immigration Status Requirement: The applicant must have, or have last been granted, permission as an Innovator Founder.

Qualifying Period Requirement: You must have lived in the UK for 3 years using an Innovator Founder or Innovator visa. You cannot include time spent in the UK using any other visa.

Time outside the UK: You must have spent no more than 180 days outside the UK in any 12 months.

New Endorsement Requirement: You must have a new endorsement that verifies you’ve met the requirements to grow your business.

Knowledge of life in the UK: If you are 18 to 64, you must pass the Life in the UK Test.

Suitability Requirement: The applicant should meet the suitability requirements as set out in the Immigration Rules. Also, the applicant must not be:

  • in breach of immigration laws, except that where paragraph 39E applies, that period of overstaying will be disregarded; or
  • on immigration bail.

New Endorsement Requirement

To qualify for ILR as an Innovator Founder, the applicant must have been issued with an endorsement letter by an Endorsing body or Legacy Endorsing Body no more than 3 months before the date of application, and that endorsement must not have been withdrawn.

The endorsement letter must include all of the following information:

  • confirmation that the applicant has shown significant achievements, judged against the business plan assessed in their previous endorsement; and
  • confirmation that the applicant’s business is registered with Companies House and the applicant is listed as a director or member of that business; and
  • confirmation the business is active and trading; and
  • confirmation that the business appears to be sustainable for at least the following 12 months, based on its assets and expected income, weighed against its current and planned expenses; and
  • confirmation the applicant has demonstrated an active key role in the day-to-day management and development of the business; and
  • confirmation the applicant’s business venture has met at least two of the following requirements:
    • at least £50,000 has been invested into the business and actively spent furthering the business; or
    • the number of the business’s customers has at least doubled within the most recent three years and is currently higher than the mean number of customers for other UK businesses offering comparable main products or services; or
    • the business has engaged in significant research and development activity and has applied for intellectual property protection in the UK; or
    • the business has generated a minimum annual gross revenue of £1million in the last full year covered by its accounts; or
    • the business is generating a minimum annual gross revenue of £500,000 in the last full year covered by its accounts, with at least £100,000 from exporting overseas; or
    • the business has created the equivalent of at least 10 full-time jobs for settled workers; or
    • the business has created the equivalent of at least 5 full-time jobs for settled workers, each of which has a mean salary of at least £25,000 a year (gross pay, excluding any allowances).

An applicant cannot meet the above requirements by relying on the same criterion twice (for example, an applicant who has invested £100,000 (2 x £50,000) in their business venture will be considered to have met one criterion, not two).

Can I reapply for ILR as an Innovator Founder after a refusal?

You may be able to reapply for ILR as an Innovator Founder if the Home Office UKVI has refused your application for ILR as an Innovator Founder, and you do not believe you can successfully challenge the refusal of your application. Any such fresh application should meet the requirements as set out in paragraph 39E of the Immigration Rules.
