Fee Waiver for Spouse Visa Extension (10 Years Route)

You can apply for a fee waiver online if you are submitting an application for an extension of a spouse visa under the 10-year route and cannot pay the Home Office UKVI fees. Home Office UKVI decision-makers must consider the full amount payable by an applicant when a fee waiver request is made. The whole amount refers to the immigration application fee and the Immigration Health Surcharge (IHS) combined. Where an applicant can pay the whole of the immigration fee but none, or only part of the IHS, the immigration fee will be required, and the waiver will be applied to the IHS. If the applicant is unable to pay the fee or the IHS, the Home Office UKVI will waive both. Read More

The applicant's relationship with the UK sponsor must be genuine and subsisting, and appropriate evidence of the genuineness and subsistence of the marriage should be provided in support of an application for an extension of a spouse visa.

Age requirement: Both the applicant and the UK spouse must be aged 18 or over.

Suitability Requirement: The applicant should meet the suitability requirements as set out in Appendix FM to the Immigration Rules.

EX1 Requirement for Extension of Spouse Visa (10 Years Route)

One of the key requirements for the applicant to succeed in an application for an extension of a spouse visa under the 10-year route is to meet the requirements of paragraph EX1 of the Immigration Rules.

The requirements of EX1 can be satisfied by showing that either:

  • the applicant has a parental relationship with a child under 18 who is in the UK and who  is:
    • British Citizen; or
    • holding ILR; or
    • has lived in the UK continuously for 7 years; and
  • it is unreasonable to expect such a child to leave the UK.

OR

  • the applicant has a genuine and subsisting relationship with the UK spouse who is either a British Citizen, a person with ILR / settled status, an EU national with pre-settled status, a refugee, a Turkish Businessperson visa holder or a Turkish Worker visa holder, and there are insurmountable obstacles to family life with that partner continuing outside the UK. Insurmountable obstacles mean the very significant difficulties which would be faced by the applicant or their partner in continuing their family life together outside the UK, and which could not be overcome or would entail very serious hardship for the applicant or their partner.

An applicant who has previously met the requirement of paragraph EX1 in one of the previously granted applications under the spouse visa 10-year route should automatically meet this requirement on the basis of the previously granted application.

Frequently Asked Questions (FAQs) For Spouse Visa Extension (10 Years Route)

The following are the various frequently asked questions (FAQs) about an application for an extension of a spouse visa under the 10-year route:

A spouse visa extension (10-year route) allows individuals in the UK under the family life (10-year route) to extend their stay for a further 2.5 years (30 months). This route applies where applicants do not meet all the requirements of the 5-year route but have valid grounds under Appendix FM based on family or private life.

You may qualify for an extension of a spouse visa under the 10-year route if:

  • You are in a genuine and subsisting relationship with a British citizen or settled person
  • You have already been granted leave under the 10-year partner route
  • You meet the suitability requirements (no serious immigration breaches or criminality)
  • You demonstrate an ongoing family life in the UK

This route often applies where applicants rely on exceptional circumstances or human rights grounds (Article 8 ECHR).

A spouse visa extension on the 10-year route is granted for:

  • 30 months (2.5 years) per extension

You will usually need to apply for multiple extensions before becoming eligible for settlement.

To qualify for Indefinite Leave to Remain (ILR) on the 10-year partner route:

  • You must complete 10 continuous years in the UK under this route
  • This typically involves 4 extensions of 30 months each

You must apply using:

  • FLR(FP) form (Further Leave to Remain – Family/Private Life)

This application is submitted online via the UKVI system.

No. Unlike the 5-year route, there is no strict minimum income threshold to apply for the extension of a spouse visa under the 10-year route.

Yes, you may switch if you meet all requirements of the 5-year route, including:

  • Financial requirement
  • Immigration status requirements

Switching can significantly reduce the time to settlement (ILR).

The documents required for a spouse visa extension under the 10-year route may vary depending on the applicant's circumstances. Typical documents may include:

  • Valid passport and eVisa
  • Proof of relationship (marriage certificate, cohabitation evidence)

  • Evidence of family life with partner and children (if any)

Yes, you are allowed to:

  • Be self-employed
  • Study in the UK
  • There are generally no work restrictions.

No, unless you switch to the 5-year route, the 10-year route requires 10 years of continuous residence before you qualify for ILR. If you switch to the 5-year route, you will need to spend 5 years continuously with leave to remain under the 5-year route to qualify for ILR after 5 years.

Exceptional circumstances refer to situations where:

  • Refusal would result in unjustifiably harsh consequences
  • It would breach your right to family life under Article 8 ECHR
  • It would be unreasonable to require a child of the applicant to leave the UK

This is a key basis for applications under the 10-year route.

Processing times are usually:

  • Standard service: up to 12 months and sometimes even longer
  • Super Priority Service: faster decisions within 24 hours
