What is Crown Service?
According to the Home Office, UKVI Guidance, in general, an applicant is in Crown service if:
- in an established permanent position, which can include a fixed-term
appointment; and - paid for his/her service directly from funds voted by Parliament; and
- rendering service directly to the Crown
Honorary appointments, such as legal adviser to a British Embassy or High Commission, are not necessarily excluded from this definition. A statement or certificate from a Government Department or branch of the Armed Service, etc., should normally be accepted as evidence that the person is in Crown service.
What are the Requirements for Naturalisation Based on Crown Service?
Applicants applying under s.6(1) on grounds of Crown service abroad have to meet the requirements of good character, language and future intentions. But it is consistent with the principles of the BNA 1981 that applicants in Crown service abroad should also demonstrate that their service and connections with the United Kingdom are such as to make it right that the Home Secretary should exercise his/her discretion and naturalise them.
Additionally, the crown service applicants are expected to meet the following criteria for their applications for naturalisation as British Citizens to succeed:
Quality of service
The Home Office, UKVI, should normally expect applicants:
- to be the holder of a responsible post; and
- to have performed their duties to an exceptionally high standard
Examples are:
- outstanding military service, especially in times of war
- outstanding service representing Her Majesty's Government (e.g. as vice consul)
- other service, significantly above and beyond the call of duty, which has been of direct benefit to the UK and its interests
Connections with the UK
These are, in order of importance:
- past residence in the UK. The longer and more recent the residence, the better. A future intention to move to or return to the UK is not relevant to
establishing a connection with the UK - whereabouts of close family members: spouse, children, parents, siblings, UK or elsewhere
- whereabouts of property house, other property, investments, including savings accounts, in the UK or elsewhere
- whereabouts of, and contacts with, friends in the UK or elsewhere
Rank or grade
The more senior the applicant, the greater the likelihood that they will be able to meet the outstanding service requirement, though this does not rule out an applicant who has served in a junior post and who may have performed particularly deserving service.
Loyalty
Tested and demonstrably beyond question. For example, applicants may have put themselves at risk from a hostile foreign government or made themselves unpopular among their people by their commitment to the UK.
Length of service
Long service alone is not sufficient, but we would normally expect exceptional service to have been maintained for a significant period, rarely less than 10 years.
Naturalisation Based on Crown Service - Advantageous to the UK
An application from someone in Crown service who does not meet some or any of the criteria above may be made on the grounds that it would be advantageous operationally for that person to be a British citizen. In such cases, the employing department or service must demonstrate that advantage in some detail. An application put forward on this ground alone is rarely likely to succeed unless it can be shown that it is vital to UK interests that the applicant should be naturalised.
What Is a Request for Priority Service?
Where the Foreign and Commonwealth Office (Consular Directorate or an overseas post) requests that priority be given to an application on behalf of a Crown Servant, the application should be dealt with out of turn and processed as quickly as possible.

Frequently Asked Questions (FAQs)
The following are the various Frequently Asked Questions (FAQs) about applying for naturalisation as a British Citizen based on Crown Service:
Naturalisation as a British citizen based on Crown service allows individuals who have been employed by the UK government or serving the Crown overseas to apply for British citizenship under special provisions of the British Nationality Act 1981.
Applicants who are engaged in Crown service outside the UK may qualify for British citizenship even if they do not meet the standard residence requirements normally required for naturalisation.
Specialist immigration solicitors at Premium Solicitors can assess your eligibility and guide you through the naturalisation application process.
Crown service generally refers to employment under the UK government or the Crown, including roles carried out overseas on behalf of the United Kingdom.
Examples may include:
- Employment with UK government departments
- Service with the British Armed Forces
- Diplomatic or consular service
- Employment with certain British government agencies overseas
- Other official roles carried out in the service of the Crown
Eligibility will depend on whether the employment qualifies as Crown service under UK nationality law.
You may be eligible to apply for naturalisation based on Crown service if:
- You are aged 18 or over
- You are of good character
- You are currently serving the Crown or have done so in the past
- Your service was outside the United Kingdom
- The Secretary of State is satisfied that granting citizenship is appropriate in your circumstances
Each case is assessed individually, and the Home Office has discretion when deciding these applications.
Holding Indefinite Leave to Remain (ILR) based on Crown Service is not a mandatory requirement, and the Home Office may exercise discretion in Crown service cases, particularly where the applicant has spent significant time serving the UK overseas.
Our British citizenship solicitors at Premium Solicitors can assess whether you meet the settlement requirement.
Standard naturalisation applications normally require applicants to:
- Have lived in the UK for at least 5 years
- Meet strict absence limits
However, for applicants serving the Crown overseas, the Home Office may waive or modify residence requirements due to the nature of the service.
This means time spent outside the UK while serving the Crown may still count towards eligibility.
In some circumstances, spouses, civil partners, or dependants of Crown servants who have been living overseas due to Crown service may also benefit from discretionary provisions when applying for British citizenship.
Each application is assessed individually, and applicants must still satisfy:
- Good character requirements
- English language requirements
- Life in the UK Test (if applicable)
The documents required for the application for naturalisation based on Crown Service may vary depending on the applicant's circumstances. Typically, applicants applying for British citizenship based on Crown service may need to provide documents such as:
- Passport and identity documents
- Evidence of Crown service employment
- Letters from the relevant government department
- Proof of immigration status or ILR
- Residence and travel history
- Evidence of English language ability
- Life in the UK Test certificate
Proper documentation is essential to avoid delays or refusal.
Applicants must demonstrate that they are of good character. The Home Office may consider:
- Criminal convictions
- Immigration history
- Compliance with UK laws
- Financial conduct, such as bankruptcy or tax issues
- Any deception in previous immigration applications
- Illegal entry in the UK
Failure to meet the good character requirement can lead to a refusal of the naturalisation application.
British citizenship applications based on Crown service usually take around 3 to 6 months to be decided by the Home Office.
Processing times can vary depending on:
- Complexity of the case
- Verification of Crown service
- Additional checks by the Home Office
If your naturalisation application is approved, you will receive an invitation to attend a British citizenship ceremony.
At the ceremony, you will:
- Take an Oath or Affirmation of Allegiance
- Receive your Certificate of Naturalisation
After this, you can apply for a British passport.
Yes, the Home Office may refuse an application if:
- Eligibility requirements are not met
- The good character requirement is not satisfied
- Insufficient evidence of Crown service is provided
- Immigration rules have been breached
If your application is refused, you may be able to request reconsideration or submit a fresh application.
