UK Government's 5 Points Plan Of Changes To UK Immigration Laws From Spring 2024

In an announcement made on 4 December 2023, the Home Secretary James Cleverly said a new five-point plan will be introduced that will take effect in Spring 2024.

  1. New Minimum Salary Theshold For Skilled Workers: The minimum salary for foreign skilled workers raised from £26,200 to £38,700 (though the health and care sector will be exempt).
  2. New Income Requirement For Spouse Visa UK: The minimum income requirement for a spouse or family visa raised from £18,600 to £38,700.
  3. No Dependants For Care Workers: A ban on care workers bringing dependents to the UK and a requirement for care firms to be registered with the Care Quality Commission to sponsor visas.
  4. Changes To The Shortage Occupations List: Reform of the Shortage Occupation List and the ending of the 20% going rate salary discount for shortage occupations.
  5. Tigtening Of Rules For Students: A tightening of the rules on students bringing family members to the UK, plus a full review of the graduate visa route by the Migration Advisory Committee.

 

You can apply for switching from Student dependant visa to Graduate dependant visa from inside the UK if the main applicant i.e. Student is either applying or has applied for Graduate visa under the Graduate route. An application for Graduate dependant visa can only be made from inside the UK and the applicant must already be in the UK on Student dependant visa at the time of application. An application for Graduate dependant visa is made in accordance with requirements as set out in Appendix Graduate of the Immigration Rules.

Which Family Members Can Qualify For Switching Into PSW Dependant Visa?

The following family members of the PSW migrant can qualify for switching into dependant visa:

  • husband, wife or civil partner of PSW migrant; or
  • unmarried or same-sex partner of PSW migrant; or
  • child aged under 18 years old of PSW migrant.

Your dependant children can be over 18 years old if they entered the UK on dependant visa whilst they were under 18 but have since turned over 18.

Requirements For Switching Into Graduate Dependant Visa

An applicant applying for switching from Student dependant visa to Graduate dependant visa should meet the following requirements of Appendix Graduate Route:

Valid application: The applicant must submit a valid application for Graduate dependant visa in accordance with requirements as set out in Appendix Graduate route;

Switching requirement: The applicant must be in the UK on student dependant visa and the main applicant should either be applying for Graduate route visa at the same time or has a pending Graduate route visa application;

Relationship requirement: The applicant must meet the relationship requirement as per Appendix Graduate of the Immigration Rules;

Age requirement for partner: If the applicant is applying as a dependent partner they must be aged 18 or over on the date of application;

Age and care requirement for child: If the applicant is applying as a dependent child they must be aged under 18 on the date of application unless they were last granted permission as the dependent child of their parent or parents. If the applicant is a child aged under 18 on the date of application, there must be suitable arrangements for the child’s care and accommodation in the UK, which must comply with relevant UK legislation and regulations;

Suitability requirement: The applicant must not fall for refusal under Part 9: grounds for refusal;

Financial requirement: The applicant must meet the financial requirement as per Appendix Graduate of the Immigration Rules. 

Not be in breach of immigration laws: The applicant must not be:

  • in breach of immigration laws, except that where paragraph 39E applies, that period of overstaying will be disregarded; or
  • on immigration bail.
