A person applying for ILR as a BNO adult dependent relative should meet the following requirements of the immigration rules:

Valid Application

You must submit a valid application for ILR as a BNO adult dependent relative from inside the UK in accordance with the requirements for a valid application as set out in Appendix Hong Kong British National (Overseas) of the Immigration Rules.

Qualifying Period Requirement

The applicant must have spent a continuous period of 5 years in the UK with permission, on a route under which a person can settle, of which the most recent grant of permission must have been on the Hong Kong BN(O) route.

Continuous Residence Requirement

The applicant must meet the continuous residence requirement as specified in Appendix Continuous Residence during the qualifying period.

Suitability Requirements

The applicant must not fall for refusal under Appendix Part Suitability of the Immigration Rules.

The applicant must not be:

in breach of immigration laws, except that where the Exceptions for overstayers section of Part Suitability applies, that period of overstaying will be disregarded; or
on immigration bail, except where they have been placed on immigration bail after making an asylum claim in the UK.

Relationship Requirement for BNO Adult Dependent Relative

Where the applicant has or last had, permission as an adult dependant relative on the Hong Kong BN(O) route, they must be the parent, grandparent, brother, sister, son or daughter of a person who:

last had permission as a BN(O) Status Holder or the partner of a BN(O) Status Holder or the BN(O) Household Member or the partner of the BN(O) Household Member and who is at the same time being granted settlement on the Hong Kong BN(O) route; or
is settled and whose last grant of permission prior to settlement was as a BN(O) Status Holder or the partner of a BN(O) Status Holder or the BN(O) Household Member or the partner of the BN(O) Household Member; or
is a British citizen.

English Language and Knowledge of Life in the UK Requirement

Unless an exemption applies, the applicant must demonstrate English language proficiency at level B1 or higher in speaking and listening on the Common European Framework of Reference for Languages. The applicant must show they meet the English Language requirement as specified in Appendix English Language.

If the applicant is aged 18 or over, and under 65 on the date of application, they must meet the Knowledge of Life in the UK requirement as specified in Appendix KOLL.

Absences From the UK for ILR as a BNO Adult Dependent Relative

To qualify for ILR as a BNO adult dependent relative, you must meet the requirements of continuous residence, which means you cannot have had more than 180 days’ absence from the United Kingdom during any consecutive 12-month period within the 5-year period. You will need to list details of your absences from the United Kingdom, including the reasons for those absences, on your application form for ILR as a BNO adult dependent relative. You can include the period between your entry clearance being granted and your entry into the United Kingdom as part of your continuous period. Absences between the date entry clearance is granted, and the date you enter the United Kingdom are treated as an absence from the United Kingdom and will form part of the 180 days allowed within a continuous 12-month period.
