Statutory Declarations Service Birmingham - Expert Solicitors & Commissioners for Oaths

Our Birmingham-based team of Commissioners for Oaths at Premium Solicitors Ltd can witness the signatures of the declarant(s) and/or draft a Statutory Declaration. Statutory declarations are commonly used to allow a person to affirm something to be true to satisfy some legal requirement or regulation when no other evidence is available. They are thus similar to affidavits (which are made on oath).

Mr Arshad Mahmood is a Solicitor and Commissioner for Oaths at Premium Solicitors Ltd with more than 21 years of Post Qualification Experience (PQE) as a Solicitor and Commissioner for Oaths.

Statutory Declaration Services: Frequently Asked Questions

The following are various Frequently Asked Questions (FAQs) about statutory declaration services provided by our Commissioners for Oaths:

What is a statutory declaration?

A statutory declaration is a formal written statement in which you solemnly declare that specified facts are true. You must make it before a person authorised to take declarations, such as a solicitor or Commissioner for Oaths. The person taking the declaration witnesses the formal process; they do not automatically verify the truth of everything you say.

When might I need a statutory declaration?

You may be asked for one to confirm a change of name or identity, marital status, tenancy or property facts, pension information, business matters, or circumstances relevant to an application. Some organisations supply a required form or exact wording. Check the receiving organisation's instructions before arranging your appointment so that the declaration meets its requirements.

Who can witness a statutory declaration in England and Wales?

A practising solicitor who is authorised to administer oaths, a Commissioner for Oaths, a notary public, or another authorised person may take a statutory declaration, subject to the requirements of the particular document. Premium Solicitors offers this service through its solicitors and Commissioners for Oaths at its London and Birmingham offices.

Can Premium Solicitors draft my statutory declaration?

Yes. We can prepare a statutory declaration from the information you provide and arrange for it to be made before an authorised solicitor. If you already have a completed form or draft, we can also arrange an appointment to make the declaration, provided the document is suitable for that service. Tell us what the receiving organisation has requested when you book your appointment online.

What should I bring to my appointment?

Bring the unsigned declaration or form, any documents referred to in it, the receiving organisation's instructions, and valid photo identification, such as a passport or driving licence. If you want us to draft the declaration, send us the relevant information in advance so we have what we need to draft the statutory declaration.

Can I sign a statutory declaration before I arrive?

Please leave it unsigned. You should make and sign the declaration before the authorised person takes it. If you have already signed it, tell us before your appointment; you may need to sign a fresh copy in the solicitor's presence.

What happens at a statutory declaration appointment?

The solicitor will check the document and your identity, ask you to confirm that you understand its contents and that the facts you declare are true, and witness you making and signing the declaration. The solicitor then completes and signs the witnessing section with the relevant date and place.

How long does a statutory declaration appointment take?

A straightforward appointment for a completed, ready-to-sign document usually takes around 5 to 15 minutes. Allow more time if the declaration needs to be drafted, amended or accompanied by several documents. If you have a deadline, let us know when arranging the appointment.

Are appointments available at weekends or at short notice?

Premium Solicitors offers appointments seven days a week at the London office, subject to availability. Same-day or urgent appointments may also be available. Please book an appointment online in advance and tell us if your declaration has a submission deadline.

Where can I make a statutory declaration with Premium Solicitors?

You can book an appointment at our Wimbledon, London office or our Birmingham city centre office. Choose the location when booking and check the appointment confirmation for the address and arrival details.

Can I walk in without an appointment?

No, you must book an appointment online before visiting either office. Booking in advance helps ensure an authorised solicitor is available and that you select the correct service for your document.

Can a statutory declaration be made online or by video call?

No, we do not provide this service remotely by video call. Our advertised statutory declaration appointments take place at our offices, and you must attend your appointment in person.

Is a statutory declaration the same as an affidavit?

No. Both are formal statements, but an affidavit is sworn or affirmed, while a statutory declaration uses a solemn declaration of truth in the required form. The organisation requesting your document should tell you which one it requires. We can assist with both statutory declarations and affidavits.

Can a statutory declaration be used for a change of name?

It may be required as supporting evidence in some change of name procedures, including certain applications to enrol a deed poll. A statutory declaration is not automatically a substitute for a deed poll or any particular organisation's name-change requirements. Tell us which authority or organisation will receive your documents so we can identify the service requested.

Will a UK statutory declaration be accepted overseas?

That depends on the country and the receiving organisation. It may require a notary, an apostille from the UK Legalisation Office, a translation, or specific wording. Check those requirements before booking; a solicitor-witnessed declaration alone does not guarantee acceptance abroad.

Does the solicitor confirm that the facts in my declaration are true?

The solicitor witnesses you making the declaration; you remain responsible for the accuracy of its contents. Knowingly making a false statutory declaration can have criminal consequences. Read the document carefully and ask for advice if you are unsure what you are being asked to declare.

Who submits the statutory declaration after it is signed?

Usually, you send the completed declaration to the organisation that requested it, unless a separate submission service has been agreed. Before leaving, check whether that organisation needs the original, a scanned copy, any exhibits, or further certification. We can provide a scanned copy as part of our published ready-drafted declaration service package.

Ready to book? Book a statutory declaration appointment online with Premium Solicitors in Wimbledon, London or Birmingham. If you need us to draft the declaration, contact us with the receiving organisation's instructions first.
